File removed by Mediafire....

Wanted to upload something with mediafire today, got a message from mediafire that started like this:

Dear MediaFire User:

MediaFire has received notification under the provisions of the Digital Millennium Copyright Act ("DMCA") that your usage of a file is allegedly infringing on the file creator's copyright protection. The file named om radesa vol 4.rar is identified by the key (lyad25ocl8c68hs). As a result of this notice, pursuant to Section 512(c)(1)(C) of the DMCA, we have suspended access to the file.

The reason for suspension was:

BDM user "lachandra" says: Hello, My Name is Hervé Lemaire , CEO of LeakID, I am legal representative of lemaire which does business under the name Metropolitan, Authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. You are hereby given notice valid under the DMCA copyright infringement notification requirements, 17 U.S.C.512. I am the designated agent of the owner of the copyrights of the images and audio/visual works listed below. I believe that the images and audio/visual works listed at the times cited below are being copied and distributed in a manner that has been not authorized by the owner of the copyrights, its agent or the law. All link below containing pirated versions of lemaire copyrighted works. The information in the notice is accurate, under penalty of perjury. Please remove all linksAs soon as possible, we will check them everyday. Thanks to inform us about y our actions. We appreciate your efforts toward this common goal. Guess I'm lucky, they didn't kill off all my links but what the hell???? A record as obscure as that Radesa record? That came out some 30 years ago if it isn't longer....

Maybe it's better if I won't say what I think about people like mister Lemaire, but the Vichy regime comes to mind....

  2. yeah i'm kind of puzzled by that too, i can't imagine people from a group that doesn't exist for decades from a country where people got paid once every record they made, no royalties what so ever, and record companies that have been defunkt for decades complaining to some idiot all the way in france....

  4. I wouldn't be surprised if they (entertainment industry) at random scare people. We should contact this Herve directly, put al lawyers name under it and see how he reacts. Your first reaction is so true how can he claim music old like that. Let him proof his right. If the original artist who is involved is still alive, can he state something?

  5. i'm now a hundred % sure this guy is A FRAUD, he's claiming adobe premier, all sorts of stuff and i wonder what he's getting out of this, again it reminds me of the Vichy regime (the French regime that collaborated with the Nazi's during World War II)70 years ago this guy would be making his money searching for Jewish kids to send to the death-camps, I don't even care about that one link that's gone but people like him really, really piss me off big time...

    seen a bit of stuff googeling about mediafire and deleted links and this guy's name keeps popping up and I'm surprised that mediafire, the company, is giving in to such obvious fraudsters...

  12. well, I send a message to mediafire, explaining that this Hervé Lemaire is a FRAUD who is not only hurting many, many people with his (or their it's not sure if this really is one man or a group of FRAUDSTERS using this name)actions and is actually giving their company, mediafire, a bad name... Probably wont have any effect what so ever but I just had to write them... I expect them to delete my account honestly, and soon too, we'll see what will happen then.... I know there's a lot of truly bad people but every now and then it surprises me how low some folks can go....

  18. From what I've read, it looks like Mediafire is forced to pull things down by the DMCA. As soon as you file a counterclaim, however, the clock begins ticking for Lemaire, who must support his claim within ten days. If he does not, your stuff is freed. It's a completely bogus system that does not give YOU ten days to respond. It's being abused by this guy, and it's been abused before. The biggies take it for granted that nothing will happen to them. They have nothing significant to lose by firing a shotgun into the crowd.

    Iamtheleastmacchiavellian linked an interesting story about legal wrangling between Warner and Hotfile, which is being sued by several media companies. For some reason -- perhaps to resolve the conflict -- hotfile gave Warner a tool that allowed them to search the hotfile servers and remove files they judged to violate their copyright. Hotfile subsequently sued Warner for carelessly deleting files without confirming their identity. Worse, they even deleted files that they knew were not theirs, but which they considered a threat.

  19. Would encrypting your files solve the problem? You should probably give them meaningless names, codes that would not be keywords in their algorithm.

  20. ha.ha....can we asked mr lamaire the proof that he/his organisation indeed have a legal copyright claim for the radesa album ? maybe then the radesa guys can countersue him for damage..god knows these guys rarely make a dime from their records. (the money comes from the concert/performances, much as the current business models for musicians in US/Europe).

Hammer, Jontowel, Clazy and all the others commenting herem thanks:) Yeah it's ABSURD what this Lemaire is doing and I imagine mediafire getting flooded with complaints and countersuits and stuff right now... One link removed isn't such a big deal (although the reason why, Lemaire and mediafire giving in so easily is) but with their no-mercy policy these days I think my account will probably be shut down very soon. If that happens it's POOF!!! nearly a thousand albums gone, but I guess it's no use crying over spilled milk lah.... And yes, Clazy I think from now on I won't name my files with the whole name of the artist and the album....

    And you're right Jontowel, it's crazy, this guy claiming ownership of a Radesa album, but they also removed Bandcamplinks from other blogs because of this guy and his fraudulent claims, albums put out by underground artists where no copyrights are involved have been removed and it just reflects so bad on mediafire as a company and I wrote them and told them that, like I said, I just hope that many, many people are writing that to them too....

    But no pressure here:) Busy with a lot of stuff right now that's way more important to me than this cheap-ass Lemaire idiot:)

  23. Have you thought about hosting the files on your own server?

    I am not really sure how much that would cost - do you get any visibility on how much bandwidth, etc. you are using?
